Community Notice: The Meadow Vista HOA Monthly Board of Directors Meeting, September 20th, 2010 at 6:45pm MST at the Meadow Vista Clubhouse
With questions raised at our January 2009 HOA Board meeting, emails received, and discussion with Homeowners in our neighborhood, the below FAQ (Frequently Asked Questions) list has been put together to help you. If the below does not answer a question you have, please contact our Community Manager, and he will be able to help you further.
Q) When was the parking restrictions communicated?
A) Restrictions to parking on Meadow Vista's private streets has been included in the HOA's CC&Rs and Association Rules documents since the first home closed in the community. All Homeowners are provided copies of the CC&Rs and Association Rules with their closing documents at the Title agency. Discussion of the parking issues Meadow Vista have been plagued with has been discussed in many monthly Board meetings in which Homeowners are invited to attend. The decision to consider and contract with All City Towing was made at the November 17, 2008 Open Board meeting. On December 4, 2008, additional signage to the already installed parking restriction signs at each entrance to the community were installed on every street in Meadow Vista. The mailed announcement for towing vehicles was distributed to all Homeowners on December 22, 2008, and posted on the Community's website. An updated copy of the Association Rules, which had been revised, was also distributed to all Homeowners on December 22, 2008. Further detailed discussion was also a large part of the January 19, 2009 open Board meeting with the Homeowners.

Q) I have a problem with the parking rule, and I know where Board members live. Should I go and talk with them about my concern?
A) No. Board members are not allowed by Arizona Law to discuss community issues outside of Board meetings. Please contact our Community Manager about any concern that you have. A single Board member is unable to help you.
Q) Can we park at the Clubhouse parking?
A) Without a temporary parking permit, residents and guests can park at the Clubhouse between 11pm and 8am and not risk being towed. However, be sure not to park in that space between 8am and 11pm without a temporary parking permit.
Q) Can we park in the driveway of a home that is vacant?
A) Although a home may be vacant, it is considered trespassing. The Board does not recommend parking in the driveways of vacant homes. If you choose to park at vacant homes, you take full responsibility of any claim made against you by the homeowner, whether it be an individual or a bank.
Q) Is it ok to park on the street during the day?
A) The rule on parking on the street is very clear. No parking on Meadow Vista Streets is allowed.
Q) The Association Rules says we can temporarily park on the streets for up to 48 hours in a 7 day period. How is this provided?
A) Temporary parking permits are available upon request and review. Homeowners can request permits using the request form on our community's website, http://www.meadowvistahoa.com. For those who do not have access to the Internet, our Community Manager can assist with completing the request form. Tenants must go through their landlord to request temporary parking permits.
Q) Who should I call if my vehicle is towed?
A) Please call All City Towing in Mesa at 480-ALL-CITY (480-255-2489)
Q) I have a concern that "No Parking" signs are not properly posted.
A) All signage meets or exceeds local and state ordinances on parking restriction signage for Unincorporated Pinal County.
Q) My vehicle was towed, however I had been issued a Parking Permit.
A) Please call All City Towing in Mesa at 480-ALL-CITY (480-255-2489) and speak with a Supervisor. If your permit is on the front dashboard on the driver's side with the "DO NOT TOW" statement facing up and the vehicle was collected by All City Towing before 8am the morning after the last circled day on the permit, All City Towing will be responsible on returning your vehicle to you at no charge. Be sure to inspect your vehicle upon receipt for any damages that may have happened while in All City Towing's care, and file any claims if needed with the towing company.
Q) My vehicle was towed, and when I went to get it at the impound yard, there was damage on it. How is the HOA going to fix this?
A) As communicated in the announcement letter and the Association Rules documents distributed to all homeowners, Meadow Vista HOA is not responsible for any damage to vehicles collected on community property (streets, Clubhouse parking spaces, etc.). If your vehicle was damaged while in the Towing company's care, the owner of the vehicle will need to file a claim with the Towing company.
Q) I think I may be a few months behind in my assessments and fines. Am I still able to request a parking permit?
A) The Homeowner will need to be caught up on their accounts for consideration of a temporary parking permit to be issued.
Q) What is the expected turn around after requesting a parking permit.
A) The Board members request 2 business days for reviewing and issuing permits. If you have not received an answer after 2 business days, please contact the Community Manager for support.
Q) I need a permit tonight for a last minute planned need. What can I do?
A) If you need to provide a parking space to someone spending the night, if they are able to use the Clubhouse parking after 11pm, this is preferred. However, if you need immediate assistance, please complete the request form and contact the Community Manager for assistance.
Q) Can I hold Board Members or the Community Manager liable for my vehicle being towed?
A) The Association's CC&Rs answers this question best:
5.4 Personal Liability.
No Board member, committee member (including, but not limited to, the Design Review Committee), officer or employee of the Association shall be personally liable to any Member or to any other person or entity, including the Association, for any damage, loss or prejudice suffered or claimed on account of any act, omission, error or negligence; provided, however, the limitations set forth in this Paragraph 5.4 shall not apply to any person who has failed to act in good faith or has engaged in willful or intentional misconduct. The Association shall indemnify its committee members, directors and officers when acting on behalf of the Association, to the full extent permitted by law, except for willful misconduct and bad faith acts or omissions.
Q) I am a Homeowner. Is the Board required to notify my Tenants of the parking restrictions?
A) Per Section 4.1.31, "... The Owner shall remain liable for compliance with the Declaration, Articles, Bylaws, Rules and Design Guidelines and shall be responsible for any violation thereof by his Tenant or his Tenant's family and guests. All notices shall be sent to the Owner."
